Identifying the defendants for the tort claim
When making a tort claim, the claimant must sue the person(s) at fault for causing harm to the claimant. The claimant will typically sue the drivers and owners of other vehicles involved in the accident, and if the claimant was a passenger then the driver of the vehicle the claimant was in may also be named as a defendant. However, it may also be appropriate to name the employer of a defendant driver even if the employer was not the owner of the vehicle that defendant driver was driving.
