Assessment of fault
Assessment of who was at fault for causing an accident is relevant for a number of purposes:
- it determines who has a right to make a tort claim for loss and damage arising out of the accident;
- it determines the impact on the insurance premiums of the owners of the vehicles involved in the accident; and
- depending on the level of culpability, the persons at fault for causing an accident may be subject to regulatory, or even criminal, penalties.
